1. Agreement

These Terms & Conditions ("Terms") are a binding agreement between you and Executable Technologies, a company established in the United States ("Company", "we", "us"; exeapps.com), governing your use of the o3vpn service, its websites, and its client applications (together, the "Service"). By creating an account or using the Service you accept these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

o3vpn provides organization-managed virtual private network connectivity built on the WireGuard® protocol. Organizations manage their own members and devices; encryption keys for your devices are generated and stored on-device. The Service is a privacy tool operated transparently: our Privacy Policy describes exactly what little we store.

3. Accounts and organizations

You are responsible for the accuracy of your account information, for safeguarding your sign-in credentials, and for all activity under your account. Organization administrators may add, remove, and revoke members and devices within their organization; leaving an organization or having a device revoked ends the associated access.

4. Acceptable use

You agree not to use the Service to:

  • engage in any activity that is unlawful in an applicable jurisdiction;
  • attack, probe, disrupt, or gain unauthorized access to systems, networks, or data;
  • send unsolicited bulk communications or distribute malware;
  • infringe intellectual-property or other rights of any person;
  • resell or offer the Service as your own service without our written consent.

5. Your responsibility for local law

The legality of VPN use varies by country. You are solely responsible for ensuring that your access to and use of the Service complies with the laws, regulations, and licensing requirements of every jurisdiction that applies to you. If you use the Service to circumvent governmental restrictions, censorship, or other regulatory controls, you do so entirely at your own risk: the Company does not endorse such use and accepts no responsibility or liability for any consequence of it, including penalties, sanctions, or loss of access.

6. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time or location.

7. Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service. Our aggregate liability for all claims in any twelve-month period shall not exceed the amounts you paid us for the Service in that period.

8. Indemnity

You will indemnify and hold the Company harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Service in breach of applicable law.

9. Suspension and termination

We may suspend or terminate access that violates these Terms or threatens the security or integrity of the Service. You may stop using the Service and delete your account at any time. Sections 5 through 8 survive termination.

10. Intellectual property

The Service, its branding, and its software are the property of the Company or its licensors. WireGuard® is a registered trademark of Jason A. Donenfeld; o3vpn is an independent product and is not sponsored or endorsed by the WireGuard project.

11. Changes

We may amend these Terms as the Service evolves. Material changes will be posted on this page with a new effective date; continued use after a change constitutes acceptance.

12. Governing law and contact

These Terms are governed by the laws of the United States and of the state in which Executable Technologies is organized, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts of that state. Questions about these Terms: ops@exeapps.com.
